Amendments to the Law on Foreigners and to the Cuban National Passport

The Cuban Ministry of Foreign Affairs (Minrex) has reportedly announced the implementation of legal changes related to procedures, Foreigners Act, and cuban passports.

State media reported that the Ministry of Foreign Affairs is currently drafting the final touches to introduce legal reforms in the area of migration. They indicated that these would be related to changes in passport procedures, functionality and processing.

In his statements, Ernesto Soberón did not provide further details regarding the specific changes to be developed. This creates a high level of expectation, specifically regarding the procedures and functioning of this travel document.

The official highlighted the fact that, by introducing these changes in the procedures for foreigners and Cuban passports, the Ministry of Foreign Affairs is looking forward to being constitutionally up-to-date. From 2019, Cuba is governed by a new national Constitution, containing provisions which require adjustments to be made.

 

Effects of this Cuban foreigners act

 

This new information has created a high level of expectation about whether in practice this law would actually help Cuban citizens or not.

It is worth pointing out that Cuban passports are among the most expensive and the shortest valid passports in the world. Furthermore, there are very limited possibilities for Cuban citizens to use it, being obliged to spend considerable sums of money to have it updated.

Under current passport procedures laws and foreigners act, Cubans currently spend nearly USD 1,000 every six years for their travel document. Clearly, it is a large amount of money which not everyone can afford to pay. This amount is expected to be decreased with the new law.

These adjustments will hopefully also permanently change the current policy on entry to Cuba with anexpired passport. Since after the outbreak of the Covid19, the Minrex implemented a policy allowing Cubans from abroad to enter the country with expired passports
