Creation and revocation of power of attorney abroad for use in Cuba

A power of attorney is a means by which an individual or entity may authorize others to represent them in the management of their property and in making decisions in accordance with their particular interests.

The function of a power of attorney is to allow a person of full trust to act on behalf of another person in situations where that person cannot act on their own behalf.

As it is logical, the need to resort to this legal resource can arise in the most diverse circumstances, so that the elaboration and legalization of a power of attorney can be done in the presence of both parties, but it can also be done remotely in a legal and safe way.

Where to prepare a power of attorney for use in Cuba abroad?

This process is really easy and you should do it at the beginning of the process:

Option 1

A Cuban Consulate abroad, an institution that will allow you to exercise your will on the island by granting power of attorney to a specific person chosen.

Note: Some consulates allow you to go in person to request an appointment, but most consulates require you to request an appointment online or by email.

Option 2

A notary public in your country can draft the Power of Attorney and arrange for it to get legalized by the Cuban Consulate.

Note 1: A translated copy must be legalized in all cases where the language of the original document is not Spanish.

Power of attorney application requirements

  • National Identity Card
  • Information about the person in Cuba to whom the authorization is to be given
  • Documents of title or other documents that are directly related to the purpose for which the power of attorney is being granted.

Delay times

The process of obtaining a power of attorney for Cuba from abroad can take from a few weeks to months, depending on whether it is done directly with the consulate or through a local notary.

Revocation of a power of attorney from a foreign country

On the other hand, a power of attorney can be revoked at the will of the parties, just as it can be granted. This procedure can also be carried out from abroad and is very similar to that described above.

First, the revoking party must notify all parties of his or her decision and file a revocation document with the Cuban consulate or a local notary, together with the original or a valid copy of the power of attorney.

Cancellation of a power of attorney through the established channels ensures that it loses its legal effect, so it is very important not to violate the procedures established for the cancellation of a power of attorney.

Note 2: The document relating to the authorisation that has just been revoked must be returned by the principal.
